1. TERMS AND CONDITIONS OF USE (LEGALLY BINDING AGREEMENT)

1.1 These Terms and Conditions of Use (“Terms”) establish a legally binding agreement between FLYNZOID INNOVATION PRIVATE LIMITED (hereinafter referred to as the “Company,” “MYDREAMSHOT,” “Us,” “We,” or “Our”), and any individual (“You,” “Your,” or “User”) accessing or using the Platform.

1.2 These Terms apply to (a) the official MyDreamShot website (“Website”), (b) the MyDreamShot mobile application (“App”), and (c) any sub-domains, related top-level domains, mobile sites, applications, APIs, widgets, content, or services made available by the Company (collectively referred to as the “Platform”).

1.3 Any data, information, text, graphics, videos, sound, images, or other materials appearing on, uploaded to, transmitted through, or otherwise made available via the Platform are collectively referred to as “Content” and are provided for participation in skill-based challenges and activities offered on the Platform (“Services”).

1.4 By accessing or using the Platform, the User agrees to be bound by these Terms, the Privacy Policy, and all other applicable rules, regulations, and policies issued by the Company.

1.5 This document is an electronic record under the Information Technology Act, 2000, generated electronically, and does not require any physical or digital signature.

1.6 By using or otherwise accessing the Platform and its Services, You expressly acknowledge and agree to abide by these Terms and the Privacy Policy.

1.7 You further acknowledge that access to and use of the Platform is strictly subject to these Terms.

1.8 By continuing to use the Platform, You confirm that You have read, understood, and fully accepted these Terms and the Privacy Policy, as amended from time to time.

1.9 You agree to comply with the specific rules and regulations governing each skill-based challenge or contest made available on the Platform.

1.10 The Company reserves the right to modify, update, amend, or terminate these Terms, the Privacy Policy, or any related policies at any time by publishing revised versions on the Platform.

1.11 At its sole discretion, the Company may notify Users of such modifications through email or in-app notifications.

1.12 If You do not agree with any modifications, You may exercise the options provided to indicate non-acceptance within the specified timeframe.

1.13 Failure to do so shall be deemed as acceptance of the revised Terms and policies.

1.14 If You choose not to accept the modified Terms, the Company may restrict, suspend, or deny access to the Platform and Services.

1.15 Where modifications to the Privacy Policy are essential for continued access, refusal to accept such changes may result in account restriction or termination.

1.16 Participation in any skill-based challenges or contests, or access to specific Content, may be subject to additional terms and conditions.

1.17 It is Your responsibility to read, understand, and comply with all such rules and regulations communicated through the Platform or official Company channels.

1.18 The Company reserves the absolute right to:
1.18.1 Modify or remove any Content posted or made available by Users;
1.18.2 Establish or adjust usage limits, thresholds, or practices related to the Platform;
1.18.3 Transfer or assign its rights and obligations related to User accounts, with notification where required by law.

1.19 Use of information available on the Platform, including results, leaderboards, statistics, or data, is entirely at the User’s own risk.

1.20 Except as expressly stated, the Company makes no warranties regarding the accuracy, reliability, or completeness of Platform information.

1.21 The Company, its affiliates, directors, officers, and agents disclaim all liability for any direct, indirect, incidental, or consequential loss or damage arising from reliance on Platform information.

1.22 By using the Platform, You expressly, unconditionally, and irrevocably consent to the lawful collection, processing, storage, and transfer of personal data in accordance with the Digital Personal Data Protection Act, 2023 and the Privacy Policy.

1.23 You acknowledge that the use of Dream Credits to participate in any skill-based challenge constitutes a separate and specific agreement, subject to the rules of that challenge in addition to these Terms.

2. GENERAL PLATFORM INFORMATION

2.1 Platform Independence
All skill-based challenges hosted on the MyDreamShot platform are operated solely by MyDreamShot. Apple Inc., Google LLC, or any other third-party companies are not sponsors, are not affiliated, and are not involved in the operation, administration, promotion, or outcome of any challenge conducted on the Platform in any manner whatsoever.

2.2 Platform Description & Legal Positioning
MyDreamShot is an ad-supported, skill-based challenge platform designed to operate in compliance with the Promotion and Regulation of Online Gaming Act, 2025 (PROGA) and other applicable laws in India. The application titled “MyDreamShot” is developed, owned, and operated by FLYNZOID INNOVATION PRIVATE LIMITED (CIN: U47412HR2025PTC130090).

Participation on the Platform is completely free of charge, does not involve real-money consideration, and does not permit deposits, withdrawals, betting, wagering, or monetary transactions by Users at any stage.

2.3 Nature of Skill-Based Challenges
The Platform features precision-based skill challenges, including formats such as “Spot the Shot.” Each challenge is designed, conducted, and verified under controlled conditions.

Participants rely solely on observation, logic, spatial judgment, experience, and precision to identify the exact impact point relevant to the challenge.

On the designated result date, outcomes are physically verified, documented, and revealed transparently on the Platform.

At no stage do the challenges involve randomization, automation, algorithms of chance, or luck-based determination. All outcomes are based purely on participant skill and accuracy.


3. PARTICIPATION MODEL

3.1 No Entry Fees or Real Money
Participation on the MyDreamShot Platform is completely free. Users are not required to pay any entry fees, and the Platform does not allow betting, wagering, deposits, withdrawals, or any form of real-money transaction.

3.2 Use of Dream Credits
Users may earn and use non-monetary promotional units known as “Dream Credits” solely for the purpose of accessing and participating in skill-based challenges available on the Platform.

Dream Credits are not currency, not stored value, and not redeemable for cash.

3.3 Promotional Nature of Credits and Rewards
All Dream Credits and rewards made available on the Platform are promotional in nature and are funded either by the Company or by sponsoring partners as part of engagement and brand-promotion activities.

Users are never required to spend real money to earn Dream Credits or to participate in any challenge.

3.4 Prohibited Uses
The Platform strictly prohibits the withdrawal, pooling, transfer, sale, wagering, exchange, or conversion of Dream Credits or rewards into real money or money-equivalent value.Dream Credits cannot be accumulated or used to influence the outcome of any challenge.

Dream Credits may only be used within the Platform, in accordance with these Terms and the specific rules applicable to each skill-based challenge.


4. DREAM CREDITS

4.1 Definition
Dream Credits are non-monetary, promotional units issued by MyDreamShot solely for the limited purpose of enabling access to skill-based challenges available on the Platform.

4.2 No Monetary Value
Dream Credits do not represent real money, stored value, digital currency, virtual assets, or any form of financial instrument.
Dream Credits have no cash value and cannot be exchanged for money under any circumstances.

4.3 Restrictions on Use
Dream Credits:
(a) cannot be purchased, sold, transferred, gifted, exchanged, or traded;
(b) cannot be withdrawn or redeemed for cash or cash-equivalent value;
(c) cannot be pooled, wagered, or staked; and
(d) may be used only within the Platform and only in accordance with these Terms and the rules of the relevant skill-based challenge.

4.4 Earning and Issuance
Dream Credits may be earned through Platform engagement, including but not limited to participation in skill-based challenges, viewing advertisements, completing Platform activities, or redeeming partner-issued promotional vouchers.

The issuance, quantity, and availability of Dream Credits are determined solely at the discretion of the Company and may vary across users or activities.

4.5 Expiry and Inactivity
Dream Credits may expire automatically if a User account remains inactive for a continuous period of thirty-five (35) days.

A User must log in and participate in at least one skill-based challenge within the inactivity period to remain eligible to earn or retain Dream Credits.

Expired Dream Credits cannot be reinstated.

4.6 No Ownership or Entitlement
Dream Credits do not create any ownership rights, entitlement, or expectation of value.
They are issued purely as a promotional and engagement mechanism and do not constitute consideration under any applicable law.

4.7 Company Rights and Discretion

The Company reserves the right to modify, limit, suspend, revoke, or discontinue Dream Credits at any time, with or without notice, including in cases of fraud, misuse, violation of these Terms, or regulatory requirements.

4.8 Display of Dream Credits and Activity History

The Platform may display a User’s available Dream Credits, usage history, participation records, or other related activity information for informational and transparency purposes only. Such display is provided solely to enable Users to track their participation on the Platform and does not constitute a wallet, stored-value facility, payment account, financial balance, or payment instrument of any kind.

Dream Credits remain non-monetary, promotional units with no cash value, and the display of such information shall not create any ownership right, entitlement, or claim against the Company.

4.9 Dream Vault (Informational Interface)

Dream Vault” is a user-interface feature provided solely for informational and transparency purposes, which displays a User’s available Dream Credits, usage activity, and participation history.

The Dream Vault is not a wallet, stored-value account, deposit mechanism, winnings account, or financial instrument of any nature. It does not hold money, winnings, or real-world value and does not permit deposits, withdrawals, transfers, encashment, or redemption of any kind.

Dream Credits reflected within the Dream Vault continue to be non-monetary, promotional units with no intrinsic or real-world value, and their display does not create any ownership interest, enforceable right, or financial claim against the Company.

4.10 Promotional Coupons and Allocation of Dream Credits

Dream Credits may be allocated to Users through promotional coupons, access codes, or similar complimentary instruments issued by third-party merchants, sponsors, or partners in connection with marketing or promotional activities. Upon valid redemption of such promotional coupons on the Platform, the User may be granted a corresponding quantity of Dream Credits for participation purposes only.

Such promotional coupons and the resulting Dream Credits are provided free of charge, carry no monetary value, and do not constitute consideration, payment, or purchase by the User. Dream Credits allocated through promotional coupons are non-transferable, non-redeemable for cash, and subject to expiry and other conditions determined by the Company.

4.11 Referral Program (Refer & Earn Dream Credits)

The Company may offer a referral or “Refer & Earn” program through which an existing User may invite new users to join the Platform. Upon successful completion of referral conditions specified by the Company from time to time, the referring User and/or the referred User may be granted Dream Credits as a promotional benefit.

Participation in the referral program is voluntary and subject to eligibility criteria, usage limitations, anti-fraud checks, and other conditions as may be determined by the Company in its sole discretion. The Company reserves the right to modify, suspend, or discontinue the referral program at any time without prior notice.

Dream Credits issued under the referral program are non-monetarypromotional in naturenon-transferable, and not redeemable for cash or any cash-equivalent. Such Dream Credits do not constitute consideration, payment, income, or compensation and may be subject to expiry, revocation, or forfeiture in cases of misuse, abuse, or violation of these Terms.

4.12 Use of Dream Credits for Contest Participation

Certain skill-based contests hosted on the Platform, including specific instances of the “Spot the Shot” contest, may require Users to utilize a predefined number of Dream Credits in order to participate. The number of Dream Credits required for participation may vary depending on the contest, product, or promotional campaign and shall be clearly displayed to the User prior to participation.

The utilization of Dream Credits for contest participation does not constitute payment, consideration, wagering, or staking of money. Dream Credits are non-monetary, promotional units provided for participation purposes only and do not represent any real-world value, ownership right, or financial interest. Participation remains free of monetary charge, and no User is required to pay money to access or participate in any contest on the Platform.


5. KEY FEATURES OF THE PLATFORM

5.1 Skill-Focused Challenges
MyDreamShot offers skill-based challenges that emphasize precision, observation, judgment, and accuracy, rather than chance or luck.

5.2 Transparent Verification
All challenges are supported by transparent verification mechanisms, including clearly defined rules, objective evaluation criteria, and verified result announcements published on the Platform.

5.3 Promotional Rewards
Rewards made available on the Platform are promotional in nature, non-monetary, and are funded either by the Company or by sponsoring partners to encourage lawful user engagement.

5.4 Earning Dream Credits
Users may earn Dream Credits through various engagement-based activities, including participation in challenges, viewing advertisements, or redeeming partner-provided promotional vouchers, subject to Platform rules.

5.5 Compliance-Driven Design
The Platform is designed and operated with a focus on compliance with Indian laws, including skill-gaming regulations, consumer protection principles, and data-protection requirements.


6. LEGAL AND COMPLIANCE

6.1 Regulatory Compliance
MyDreamShot is designed to operate in compliance with the Promotion and Regulation of Online Gaming Act, 2025 (PROGA) and all other applicable laws, rules, and guidelines in force in India.

6.2 Data Protection and Privacy
The Platform complies with the Digital Personal Data Protection Act, 2023 (DPDP).
All personal data is collected, processed, stored, and handled in accordance with the Company’s Privacy Policy and applicable data-protection laws.

6.3 Age Eligibility
Access to the Platform is strictly limited to users who are eighteen (18) years of age or older.
The Platform does not knowingly permit participation by minors.

6.4 Geographic Restrictions
The Platform is intended for use only within India and is not available in restricted regions, including but not limited to Andhra Pradesh, Assam, Nagaland, Sikkim, and Telangana, or in any other jurisdiction where such platforms are prohibited by law.

6.5 Responsible Participation
MyDreamShot promotes responsible participation by offering lawful, skill-based challenges, transparent rules, and verified outcomes, without encouraging excessive or compulsive usage.

6.6 No Gambling or Betting
The Platform does not facilitate gambling, betting, wagering, or lottery-style activities.
No element of the Platform involves chance-based outcomes, real-money consideration, or prize distribution linked to monetary risk.


Description of Services Offered

6. Description of Services Offered

6.1. Subject to the User’s full compliance with these Terms, FLYNZOID INNOVATION PRIVATE LIMITED ("the Company") hereby grants the User a personal, limited, non-exclusive, non-transferable, non-assignable, non-sublicensable, royalty-free, and revocable license to access and use the MyDreamShot Platform and its Services.

6.2. This limited license is granted solely for the User’s personal, private, and lawful participation in Skill-Based Contests, Challenges, or Activities hosted on the Platform, strictly in accordance with these Terms.

6.3. The Platform shall not be used for any commercial, promotional, or unauthorized purpose.

6.4. This license remains valid only within the territory of India and for the duration of the User’s continued compliance with these Terms.

6.5. The Company reserves the absolute right to modify, enhance, suspend, or discontinue any aspect of the Platform or its Services — including but not limited to features, functionalities, information, or these Terms — at its sole discretion and without prior notice or liability to the User.

6.6. The Company shall not be obligated to provide justification or advance notice for any such modifications, updates, or service interruptions.

6.7. The User acknowledges and agrees that the Services may include advertisements or promotional content, which may be displayed or targeted based on factors such as the User’s activity, preferences, search queries, or interaction with the Platform.

6.8. The Company retains the exclusive right to determine the nature, frequency, and placement of such advertisements, which may be changed or removed at any time without prior notice.

6.9. Where the Services include access to Skill Contests or Challenges, the specific rules, scoring systems, participation guidelines, and judging criteria governing each Contest shall be made available within the respective interface.

6.10. The User agrees to carefully read, understand, and strictly comply with all such rules, criteria, and instructions prior to participation.

6.11. The User shall be solely responsible for all costs and expenses incurred while accessing or using the Platform or Services, including but not limited to internet connectivity charges, mobile data usage, or any related costs.

6.12. The Company bears no responsibility or liability for such expenses, and it shall remain the User’s exclusive obligation to ensure timely payment of these charges.

6.13. The User agrees not to use any ad-blocking software, virtual private networks (VPNs) to manipulate ad-delivery, or any other technology that interferes with the display of advertisements or the tracking of partner coupons. Any attempt to bypass or skip promotional content required for earning Dream Credits may result in the immediate forfeiture of those credits or the suspension of the Account.

7. USER REGISTRATION & ACCOUNT CREATION

7.1 Account Requirement
To access the Platform or participate in any skill-based challenge, a User must complete the registration process and create a personal account (“Account”). Until registration is successfully completed and the Account is activated, the User shall not be permitted to access restricted features or participate in challenges.

7.2 Single Account Policy
Each User is permitted to maintain only one (1) Account on the Platform.
The Company reserves the right to suspend, restrict, merge, or permanently terminate multiple or duplicate Accounts created by the same individual, with or without prior notice.

7.3 Registration Information
During registration, Users may be required to provide accurate and complete information, including but not limited to:

  • Full Name

  • Email Address

  • Mobile Number

  • Postal / ZIP Code

  • Authentication credentials (password or OTP)

  • Optional sign-in via verified third-party login providers (e.g., Google, Apple, Facebook)

7.4 Accuracy of Information
Users represent and warrant that all information provided during registration is true, accurate, current, and complete.
Any false, misleading, incomplete, or outdated information may result in immediate suspension or termination of the Account.

7.5 Account Security Responsibility
Users are solely responsible for maintaining the confidentiality of their Account credentials and for all activities conducted through their Account.
The Company shall not be liable for unauthorized access resulting from User negligence or credential sharing.

7.6 Unauthorized Use
Users agree not to allow any third party to access or use their Account.
Any activity performed through a User’s Account shall be deemed to have been performed by that User.

7.7 Verification Measures
The Company may implement verification steps such as email verification, mobile OTP, or identity checks to ensure authenticity, age compliance (18+), and fraud prevention.

Failure to complete verification may result in restricted access or suspension.

7.8 Account Suspension or Termination
The Company reserves the right to suspend or terminate any Account if it determines that the User has:

  • Violated these Terms

  • Provided false information

  • Created multiple Accounts

  • Engaged in fraudulent or abusive conduct

  • Attempted to misuse Dream Credits or Platform features

7.9 No Ownership Rights
An Account grants only a limited right to access the Platform.
Users do not acquire any ownership, proprietary, or transferable rights in their Account, Dream Credits, rankings, or Platform data.

8. CREATION OF ACCOUNT AND USE OF THE PLATFORM

8.1 Account Registration
Upon successful registration and issuance of an Account by the Company, the User shall be granted access to the Platform, its features, skill-based challenges, and related services.
The Company reserves the right to modify, restrict, suspend, or terminate any Account at its sole discretion, subject to applicable law, and with or without notice, where required.

8.2 Authorized Use of Account
The User represents and warrants that their Account shall be used solely by them and that they shall not permit any third party to access or use their Account at any time.
The User shall be solely responsible for all activities conducted through their Account, whether authorized or unauthorized.
The User further agrees not to access or attempt to access the Platform using another User’s Account.

8.3 Single Account Policy
Each User is permitted to maintain only one registered Account on the Platform.
If the Company determines that a User has created or is operating multiple Accounts, it reserves the right to restrict, suspend, or permanently terminate such duplicate or linked Accounts.
Any unused Dream Credits, rewards, or promotional benefits associated with such Accounts may be forfeited or, at the Company’s discretion, consolidated into a single verified Account.

8.4 Identity and Eligibility Verification
As part of the registration process or at any later stage, the Company may require Users to complete basic verification procedures, including mobile number verification, email verification, or presentation of a valid government-issued identification document, solely for the purposes of confirming authenticity, eligibility, age compliance (18 years and above), and fraud prevention.
The Company shall not be responsible for any delay, restriction, or limitation of access resulting from incomplete, inaccurate, or misleading information provided by the User.

8.5 Accuracy of Rewards and Dream Credits
In the event that a User’s Account is mistakenly credited with excess Dream Credits, rewards, or promotional benefits due to a system error, technical malfunction, or operational issue, the Company reserves the right to correct, adjust, or revoke such credits without prior notice.
Users acknowledge that Dream Credits and rewards are non-monetary, non-transferable, and cannot be exchanged for cash or any other financial consideration.

8.6 Data Handling and Privacy
By registering for and using the Platform, the User expressly consents to the collection, processing, and storage of their personal information by the Company and its authorized service providers solely for operational, verification, security, and compliance purposes.
Such information may include personal identifiers such as name, age, and contact details, and government-issued identification where legally required.
All personal data shall be handled in accordance with the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.
Additional details regarding data practices are set out in the Company’s Privacy Policy.

8.7 Voluntary Participation and Risk Acknowledgement
Participation in any skill-based challenge on the Platform is entirely voluntary and undertaken at the User’s own discretion.
The Platform does not involve wagering, betting, or pooling of money in any form.
The Company shall not be liable for any dissatisfaction, disappointment, or perceived loss arising from participation, outcomes, or inability to win a reward.


9. ELIGIBILITY

9.1 Age and Residency Requirements
To access and use the Platform and to create an Account, the User must be at least eighteen (18) years of age and must be a resident of India.

9.2 User Representations and Warranties
By agreeing to these Terms, the User expressly represents and warrants that the User is eighteen (18) years of age or older, has not been previously suspended, blocked, or otherwise restricted from using the Platform, and that the User’s registration, access, and participation on the Platform comply with all applicable laws, rules, and governmental regulations.

9.3 Restricted Territories
In accordance with the Promotion and Regulation of Online Gaming Act, 2025, Users who are residents of jurisdictions where skill-based online contests are restricted or prohibited are not permitted to participate in any skill-based challenges or activities hosted on the Platform.

9.4 Current List of Restricted Regions
As of the effective date of these Terms, access to the Platform or participation in skill-based challenges may be restricted or unavailable to residents of the following Indian States and Union Territories where legal clarity is pending: Andhra Pradesh, Assam, Nagaland, Telangana, and Sikkim, as well as any location outside India.

9.5 Eligibility Verification Rights
The Company reserves the right, at any stage, to request reasonable proof of age or eligibility solely for the purpose of confirming compliance with applicable laws. If a User fails to provide valid information, or if the Company has reasonable grounds to believe that a User is under eighteen (18) years of age or resides in a restricted territory, the Company may immediately suspend, restrict, or terminate the User’s access to the Platform.

9.6 Responsibility of Parents and Guardians
The Platform is not intended for use by minors. Parents and legal guardians are strongly advised to supervise and monitor the online activities of minors and dependents. The Company recommends the use of parental-control tools and supervision mechanisms to prevent unauthorized access and disclosure of personal information by minors.

9.7 Ineligibility of Company-Associated Individuals
Employees, directors, officers, consultants, agents, and any individuals directly or indirectly associated with FLYNZOID INNOVATION PRIVATE LIMITED or its partners are not eligible to participate in any skill-based challenges hosted on the Platform.

9.8 Accuracy of User Information
The User agrees to provide true, accurate, current, and complete information at the time of registration and whenever requested by the Company, and further agrees to promptly update such information to maintain its accuracy. Any misrepresentation, falsification, or omission of material information may result in immediate suspension or termination of access to the Platform.

9.9 Participation in Skill-Based Challenges
To participate in any skill-based challenge, the User must successfully register through the Platform and complete the participation process as displayed on-screen in accordance with the applicable rules.

9.10 Nature of Participation
Each skill-based challenge requires the User to apply observation, logic, judgment, or precision to determine or identify the most accurate outcome in accordance with the specific challenge rules. No challenge outcome is determined by chance.

9.11 Evaluation and Fairness
Evaluation of participation shall be conducted through a pre-defined judging mechanism, independent verification process, or expert review system, as applicable, to ensure transparency, consistency, and fairness.

9.12 Multiple Participation
Each participation attempt shall be treated as a separate entry. Users may participate multiple times in a challenge, provided that each participation complies fully with these Terms and the specific rules governing the relevant challenge.

10. SKILL-BASED CONTESTS HOSTED ON THE PLATFORM

10.1 Nature of the Platform

The Platform hosts skill-based contests only and does not support, promote, or facilitate any activity involving betting, wagering, gambling, or games of chance. Participation in contests hosted on the Platform does not require any monetary payment, and outcomes are determined solely and decisively by the User’s skill, judgment, observation, precision, and decision-making ability.


10.2 Spot the Shot – Skill-Based Contest

The Platform currently hosts a single skill-based contest titled “Spot the Shot.” “Spot the Shot” is a visual accuracy and prediction challenge in which Users apply skill and judgment to determine the most accurate target position. The Company may introduce additional skill-based contests in the future in accordance with these Terms.


10.3 Game Mechanics of Spot the Shot

In the “Spot the Shot” contest, the Platform provides Users with a fixed target image representing a shooting surface. Using on-screen controls, each User independently positions a crosshair and selects a specific target point on the image. The selected position corresponds to a set of coordinates and represents the User’s prediction, based on skill and judgment, of where the physical shot will impact.

Each instance of the Spot the Shot contest may be associated with a specific product, prize, or promotional campaign. Participation in such contest may require the utilization of a predefined number of Dream Credits, which shall be clearly disclosed to the User prior to participation.


10.4 Execution of Shot and Result Declaration

On the designated result date, a physical shot is executed under controlled conditions corresponding to the relevant Spot the Shot contest. The actual impact point of the shot is identified and mapped to corresponding coordinates on the target image. Video documentation of the shot execution and result declaration may be made available on the result date for transparency and verification purposes.


10.5 Determination of Winner

A User shall be declared the winner if the User’s selected coordinates exactly match the actual impact coordinates of the shot. In the event that no exact match occurs, the User whose selected coordinates are closest to the actual impact coordinates, as determined by objective, coordinate-based distance measurement methods applied by the Platform, shall be declared the winner.

In the event of a tie, predefined skill-based tie-break criteria shall apply. The Company’s determination of measurements, results, and winner selection shall be final and binding.


10.6 No Real-Money Participation or Wagering

The Platform operates on a free-entry, non-monetary participation model. No User is required to pay any entry fee, deposit, stake, or monetary consideration to participate in any contest. The utilization of Dream Credits for contest participation functions solely as an access mechanism and does not constitute payment, wagering, staking, or consideration of money.

Dream Credits are non-monetary, promotional units and cannot be withdrawn, transferred, traded, sold, or monetized in any manner.


10.7 User Responsibility

Users acknowledge that participation in the Spot the Shot contest is voluntary and based entirely on their own skill, judgment, and discretion. The Company shall not be responsible for individual User performance or personal decisions made during participation, provided that the Company shall conduct contests fairly, transparently, and in accordance with these Terms.

11. SPOT THE SHOT SKILL CONTEST – TIE-BREAK RULES


11.1 What Is “Spot the Shot”

“Spot the Shot” is a visual and analytical skill-based challenge in which participants are required to predict the point of impact of a physical shot based on a static visual scenario displayed on the Platform.

Each “Spot the Shot” challenge presents all participants with:

  • a fixed visual image depicting a target and an aligned shooting mechanism in a static position;

  • a clearly defined two-dimensional coordinate grid (X and Y axes); and

  • identical visual conditions, scale, and perspective for every participant.

Participants must analyze the visual information and submit a coordinate representing where they determine the physical shot will land under the depicted conditions.

The reference coordinate for each challenge is not pre-determined. It is established on the designated result date based on the actual impact point of the physical shot, which is mapped to the corresponding coordinates on the target image.

Success in “Spot the Shot” depends on the participant’s:

  • spatial reasoning and perspective interpretation;

  • visual alignment and positional judgment; and

  • precision in coordinate selection.

No element of chance, randomization, lottery mechanism, or probabilistic selection is used in determining outcomes. Participants demonstrating superior analytical skill and accuracy consistently perform better than those making uninformed or random selections.

11.2 Determination of Results

Each valid entry is evaluated based on its proximity to the actual impact coordinate established by the physical shot for the relevant challenge.

Results are determined using predefined, objective, and standardized evaluation criteria, including:

  • coordinate accuracy;

  • distance from the actual impact coordinate; and

  • consistency of placement.

The same evaluation methodology is applied uniformly across all participants to ensure fairness, transparency, and integrity.

11.3 Tie-Break Trigger

A tie-break situation shall arise if two or more participants submit valid and eligible entries that exactly match or are equally closest to the actual impact coordinate for a Spot the Shot challenge (each a “Tie-Break Entry”).

Such participants shall be referred to as “Tie-Break Participants.”

11.4 Initial Tie-Break Evaluation

If any Tie-Break Participant has submitted more than one valid entry under the same registered MyDreamShot Account, the next closest eligible entry submitted by each such participant shall be considered for tie-break evaluation.

11.5 Exhaustion of Entry-Based Comparison

If a Tie-Break Participant has no remaining eligible entries available for comparison during the evaluation process, that participant shall be eliminated from the tie-break evaluation.

11.6 Escalation to New Skill-Based Tie-Break Challenge

If the evaluation of existing entries does not result in a single winner, or if two or more Tie-Break Participants remain tied, the remaining Tie-Break Participants shall proceed to a new Spot the Shot skill-based challenge.

Such tie-break challenge shall:

  • present a new visual scenario;

  • test the same category of skills as the original challenge; and

  • relate to the same product or promotional campaign selected by the participant in the original challenge.

11.7 No Additional Cost or Consideration

Participation in any tie-break challenge shall not require any additional Dream Credits, payment, entry fee, deposit, subscription, or consideration of any kind.
The tie-break challenge shall be treated as a continuation of the original contest for the purpose of determining a single final winner.

11.8 Determination of Winner in Tie-Break Challenge

The outcome of the tie-break challenge shall be determined using the same objective evaluation criteria applicable to the original challenge. The participant whose selected coordinates are closest to the actual impact coordinate of the tie-break challenge shall be declared the final winner.

11.9 Failure to Participate

If a Tie-Break Participant fails to respond or participate in a tie-break challenge within three (3) days from notification, or within such reasonable operational timelines as communicated, the tie-break process shall continue without that participant.

11.10 Finality of Determination

The Company’s determination of measurements, evaluations, results, and winner selection under this Section shall be final and binding on all participants.


12. WINNER VERIFICATION AND PUBLICITY REQUIREMENTS

12.1 Eligibility and Identity Verification
Before confirming any User as a winner of a skill-based challenge, the Company may conduct reasonable verification to confirm the User’s identity, age, and eligibility in accordance with applicable laws and these Terms.

12.2 Verification Information
For verification purposes, a selected winner may be requested to present a valid government-issued identification document solely to confirm age and eligibility. Such verification may be conducted in-person or through other lawful means determined by the Company.

12.3 No Retention of Identity Documents
The Company does not retain copies of identity documents unless retention is required under applicable Indian laws for lawful reward fulfillment or regulatory compliance. Any verification conducted shall be limited to the minimum information necessary.

12.4 Failure to Complete Verification
If a selected winner fails to provide valid verification information within the timeframe specified by the Company, or if the Company has reasonable grounds to believe that the User is ineligible, the Company reserves the right to disqualify that User and select an alternate eligible participant.

12.5 Anti-Fraud Safeguards
Verification requirements are implemented solely as safeguards to prevent fraud, misuse of the Platform, or participation by ineligible Users, and do not constitute financial verification or monetary validation.

12.6 Winner Publicity and Content Creation
Winners may be invited to voluntarily participate in the creation of photographs, short videos, or testimonial content related to reward delivery or challenge outcomes for transparency and promotional purposes.

12.7 Voluntary Participation in Publicity
Participation in publicity activities is entirely voluntary and subject to the User’s consent. Refusal to participate in publicity or content creation shall not affect the User’s eligibility to receive the declared reward.

12.8 Use of Publicity Content
Where consent is provided, the Company may use such content on its Platform, official social media channels, or promotional materials in accordance with the Privacy Policy and applicable data protection laws.

12.9 No Cash Alternative
No cash alternative, monetary substitute, or financial equivalent shall be offered in place of any declared reward. All rewards shall be provided strictly as described in the relevant skill-based challenge or as an equivalent non-cash item determined by the Company.

13.Restricted Territory. Platform not offered in Andhra Pradesh, Assam, Nagaland, Telangana, Sikkim and outside India

13.1 Geographic Restrictions
In compliance with applicable Indian laws and state-specific regulations, the Platform is not offered in certain jurisdictions.
Access to the Platform and participation in any skill-based contest, activity, or promotional event is restricted in the following territories: Andhra Pradesh, Assam, Nagaland, Sikkim, Telangana, and any location outside the Republic of India.

13.2 Legal Basis for Restrictions
Certain Indian states impose restrictions or prohibitions on online skill-based contests or competitions where rewards, prizes, or incentives are offered, irrespective of whether participation is free.
Accordingly, the Company, acting in compliance with applicable laws and regulatory guidance, does not permit registration, access, or participation from residents of the restricted jurisdictions listed above.

13.3 Non-Monetary Participation Model
The Platform operates exclusively as a free-to-use, skill-based contest platform.
No real-money entry fees, betting, deposits, or pooled payments are accepted or processed on the Platform.
Any Dream Credits, coupons, or rewards issued are non-cash, non-transferable, and cannot be redeemed or exchanged for real currency.
Notwithstanding this non-monetary structure, Users located in restricted territories are not permitted to access or use the Platform to ensure full compliance with regional laws.

13.4 Location Verification and Access Control
To enforce territorial restrictions, the Company may implement reasonable verification and access-control measures to determine a User’s location and eligibility.
By accessing or using the Platform, Users consent to the application of such lawful verification measures.
If a User is identified as accessing the Platform from a restricted territory, the Company may restrict, suspend, or block access without prior notice.

13.5 Misrepresentation of Location
Users who intentionally misrepresent their location or provide false or misleading information to circumvent territorial restrictions shall be solely responsible for any resulting consequences.
The Company reserves the right to immediately suspend or terminate such Accounts and forfeit any unused or earned Dream Credits or promotional benefits associated with the Account.

13.6 User Responsibility and Disclaimer
The Company shall not be liable for any legal, regulatory, or statutory consequences arising from a User’s violation of territorial restrictions or applicable state laws.
Users are responsible for ensuring that their access to and use of the Platform complies with all applicable laws in their jurisdiction.

13.7 Policy Updates and Final Determination
The Company may update the list of restricted territories from time to time in response to changes in law, regulatory guidance, or government notifications.
Such updates shall take effect immediately upon publication on the Platform.
The Company’s determination regarding territorial access and User eligibility shall be final and binding.

14.Security

14.1 Account Protection and Login Security
Access to a User’s Account, including the ability to view or modify Account-related information, is protected through secure authentication mechanisms such as passwords and/or one-time verification methods.
The User is solely responsible for maintaining the confidentiality of login credentials and ensuring that such credentials are not disclosed, shared, or made accessible to any third party.

14.2 Company’s Limited Liability
The Company shall not be liable for any loss, damage, or expense arising from failure, delay, or interruption in the transmission or receipt of login credentials, passwords, or verification codes due to mobile network issues, technical failures, service disruptions, or circumstances beyond the Company’s reasonable control.

14.3 User Responsibility for Account Access
The User agrees not to disclose passwords, verification codes, or authentication credentials to any third party and not to permit any other individual to access their Account.
If unauthorized access occurs as a result of disclosure, negligence, device compromise, or failure to safeguard credentials, the User shall be solely responsible for all resulting actions and consequences.

14.4 Safeguarding User Information
The User is responsible for protecting all information provided on the Platform, including usernames, passwords, email addresses, mobile numbers, and other contact details.
The Company shall not be liable for unauthorized access, misuse, or compromise of an Account resulting from the User’s voluntary sharing of such information or use of third-party applications or services.

14.5 Unauthorized Access and Fraudulent Activity
The Company shall not be responsible for unauthorized access or fraudulent use of a User’s Account prior to receiving notice of suspected compromise from the User.
If a User suspects unauthorized access or activity, the User must promptly take reasonable steps to secure the Account, including changing credentials, and notify the Company through its designated grievance or support channel.
Failure to promptly report such activity may result in full responsibility resting with the User.

14.6 Device and Connection Security
Users must ensure that the devices used to access the Platform are secure, updated, and protected against malware or unauthorized interference.
The Company shall not be responsible for any loss, interruption, or damage caused by device malfunction, poor connectivity, or third-party interference beyond its control.

14.7 Fraud Prevention and Account Restrictions
To protect Platform integrity and User security, the Company may implement reasonable fraud-prevention measures, including activity monitoring, temporary access limitations, additional verification steps, or Account suspension.
Such measures may be applied without prior notice where necessary.
The Company shall not be liable for inconvenience, delay, or disruption resulting from actions taken in good faith for security, compliance, or fraud prevention.

14.8 Disclosure to Authorities
The Company may disclose User information to government authorities, law enforcement agencies, or regulatory bodies where required for the prevention, detection, investigation, or prosecution of unlawful or fraudulent activities.
All such disclosures shall be made in accordance with the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and applicable cybersecurity and legal requirements.

14.User Conduct and Responsible Participation

15.1 Responsible Use of the Platform
Users acknowledge that participation in contests and use of features available on the Platform are undertaken solely for entertainment, recreation, and skill development purposes.
MyDreamShot promotes responsible, balanced, and healthy participation and encourages Users to monitor the time they spend on the Platform.

15.2 Entertainment-Only Nature
The Platform is designed purely as a form of entertainment and skill-based engagement.
Users are advised to participate in moderation and to treat all contests and interactive features as recreational activities rather than as a source of income or financial gain.

15.3 No Financial Risk to Users
The Platform does not require any payment, deposit, subscription, or financial consideration from Users.
As a result, Users are not exposed to any financial risk through their participation on the Platform.

15.4 Use of Promotional Credits and Incentives
The Platform may offer Users free Dream Credits, coupon-based incentives, referral benefits, or engagement bonuses for promotional and participation purposes.
Such credits and incentives have no monetary value, are non-transferable, non-withdrawable, and may be used solely within the Platform in accordance with these Terms to access skill-based contests or other permitted features.


16. PROHIBITED ACTIVITIES

16.1 General Prohibition
Users are strictly prohibited from engaging in any activity that violates these Terms, applicable laws, or the integrity, security, and proper functioning of the Platform.

16.2 Automated or Unauthorized Access
Using bots, crawlers, scripts, scrapers, or any automated or unauthorized tools to access, interact with, or extract data from the Platform without the Company’s express written consent is strictly prohibited.

16.3 Interference or Disruption
Attempting to interfere with, manipulate, overload, damage, or disrupt the normal operation, performance, or security of the Platform, its servers, networks, or systems is prohibited.

16.4 Data Misuse
Extracting, scraping, indexing, copying, or using any data, content, or User information from the Platform for unauthorized, commercial, or competitive purposes is not permitted.

16.5 Spam or Unauthorized Messaging
Sending bulk messages, spam, chain letters, unsolicited communications, or promotional material through, about, or in connection with the Platform without authorization is prohibited.

16.6 Impersonation and Misrepresentation
Impersonating another User, individual, or entity, misrepresenting identity or affiliation, soliciting passwords or sensitive information, or providing false or misleading information is strictly prohibited.

16.7 Intellectual Property Violations
Infringing, misusing, copying, or distributing any intellectual property, proprietary content, trademarks, logos, designs, or materials belonging to the Company or any third party without authorization is prohibited.

16.8 Offensive or Unlawful Conduct
Uploading, posting, transmitting, or sharing content that is defamatory, obscene, hateful, abusive, discriminatory, misleading, or otherwise unlawful or objectionable under applicable Indian laws is not permitted.

16.9 Security Violations
Uploading, distributing, or attempting to introduce viruses, malware, malicious code, or any software intended to harm, compromise, or exploit the Platform or other Users is strictly prohibited.

16.10 Unauthorized Account Activities
Attempting to sell, trade, transfer, assign, lease, or commercially exploit User Accounts, Dream Credits, rankings, rewards, or any Platform-related attributes is prohibited.

16.11 Violation of Applicable Laws
Engaging in any activity that threatens national security, public order, national integrity, incites criminal conduct, or otherwise violates applicable central or state laws of India is strictly prohibited.


17. USER CONTRIBUTIONS AND CONTENT STANDARDS

17.1 Voluntary User Contributions
If a User chooses to submit, upload, transmit, or otherwise provide any text, comments, feedback, images, videos, or other material on or through the Platform (“Contributions”), such Contributions shall be deemed voluntary.

17.2 Legal Compliance
The User represents and warrants that all Contributions comply with all applicable laws, rules, and regulations in India.

17.3 Content Standards
The User further represents and warrants that their Contributions:

17.3.1 Do not contain any unlawful, abusive, defamatory, obscene, misleading, hateful, or discriminatory material;

17.3.2 Do not infringe upon or violate any intellectual property rights, privacy rights, publicity rights, or other proprietary rights of any third party;

17.3.3 Are not submitted for the purpose of commercial solicitation, advertising, marketing, or promotion of any product, service, or business;

17.3.4 Do not harm minors, exploit individuals, impersonate any person or entity, or misrepresent the User’s identity or affiliation; and

17.3.5 Do not contain false, deceptive, or misleading information.

17.4 Content Moderation Rights
The Company reserves the absolute right, but not the obligation, to review, monitor, moderate, edit, restrict, or remove any User Contributions at its sole discretion if such content:

(a) violates these Terms;
(b) violates applicable laws; or
(c) is otherwise deemed inappropriate, misleading, harmful, or inconsistent with the Platform’s standards.

17.5 No Obligation to Publish
The Company is under no obligation to publish, display, or retain any User Contributions and shall not be liable for the removal or non-publication of any content.


18. EXPOSURE TO THIRD-PARTY CONTENT

18.1 User Acknowledgement
You acknowledge that while using the Platform, You may be exposed to content posted by other Users that may be inaccurate, offensive, inappropriate, or objectionable.

18.2 No Absolute Control
Although the Company endeavors to maintain a safe and respectful environment, it does not guarantee that such content will always be identified or prevented.

18.3 Third-Party Advertisements

The Platform may display third-party advertisements, including banner advertisements, through external advertising partners. Such advertisements constitute third-party content and are displayed for general informational or promotional purposes only.

The display, viewing, or interaction with advertisements is entirely optional and does not affect gameplay outcomes, participation eligibility, rankings, or the allocation or use of Dream Credits. Advertisements do not provide any gameplay advantage, additional entries, benefits, or enhanced chances of success in any skill-based challenge hosted on the Platform.


18.4 Reporting Mechanism
If You encounter any content that violates these Terms or applicable laws, You may report such content to the Company through its official support channel. The Company shall review such reports and take action at its sole discretion.

18.5 Final Decision
The Company’s decision regarding the review, removal, or retention of third-party content shall be final and binding.


19. UNAUTHORIZED USE AND ENFORCEMENT

19.1 Prevention of Misuse
The Company reserves the right to prevent unauthorized access to, misuse of, or interference with the Platform through technological, administrative, or legal safeguards.

19.2 Corrective Measures
If the Company has reasonable grounds to believe that a User has engaged in unauthorized, unlawful, fraudulent, or prohibited conduct, it may take one or more of the following actions:

19.2.1 Restrict, suspend, or terminate the User’s access to the Platform;
19.2.2 Delete the User’s Account and any associated non-cash credits or promotional benefits;
19.2.3 Report such conduct to competent governmental or regulatory authorities, where required by law.

19.3 No Compensation
Users acknowledge that they shall have no claim, right, or entitlement to compensation for the loss of access, credits, points, or Account resulting from enforcement actions taken in accordance with these Terms.

19.4 Finality of Determination
The Company’s determination in matters of enforcement, misuse, or violation shall be final and binding.


20. COMMUNICATIONS AND NOTIFICATIONS

20.1 User Responsibility
Users are responsible for ensuring that they are able to receive communications from the Company, including emails, SMS messages, and in-app notifications.

20.2 Delivery Disclaimer
The Company shall not be liable if any communication remains unread, undelivered, or is filtered into spam or junk folders due to User device settings, email provider policies, or network issues.

20.3 Push Notifications

The Company may send Users push notifications through the mobile application for service-related and informational purposes only, including account updates, skill challenge announcements, result notifications, engagement reminders, and important platform notices.

20.4 Optional Nature of Notifications

Push notifications are optional and may be enabled or disabled by Users at any time through their device settings or in-app controls, subject to operating system limitations. Push notifications are not mandatory for accessing or participating in any skill-based challenge.

20.5 No Impact on Gameplay or Credits

The receipt, viewing, or interaction with push notifications does not affect gameplay outcomes, participation eligibility, ranking, or the allocation or use of Dream Credits. Data related to push notifications is handled in accordance with the Privacy Policy.



21. USERNAME RESTRICTIONS

21.1 Acceptable Usernames
Usernames selected by Users must not be obscene, indecent, abusive, misleading, or likely to subject the Company to public disparagement, ridicule, or reputational harm.

21.2 Company Rights
If a username is deemed inappropriate at the Company’s sole discretion, the Company may, without prior notice:

21.2.1 Modify or change the username and notify the User;
21.2.2 Delete the username and any associated content;
21.2.3 Restrict or deny the User’s access to the Platform; or
21.2.4 Take any combination of the above actions.


22. UNAUTHORIZED ACCESS

22.1 Prohibited Access Methods
Unauthorized access to the Platform is a violation of these Terms and applicable laws. Users agree to access the Platform only through interfaces and methods provided or expressly authorized by the Company.

22.2 Automated Tools Prohibited
The use of agents, robots, scripts, spiders, or other automated tools to access, monitor, copy, or interact with any part of the Platform is strictly prohibited unless explicitly approved in writing by the Company.


23. COMPLIANCE WITH LAWS

23.1 Legal Compliance
Use of the Platform is subject to all applicable central and state laws, regulations, and legal processes in India.

23.2 Government Requests
Nothing in these Terms shall limit or restrict the Company’s right to comply with lawful requests, orders, or directives from courts, law enforcement agencies, or government authorities in relation to a User’s activities on the Platform.


24. CONTENT RESPONSIBILITY DISCLAIMER

24.1 User-Generated Content
The Company does not control or assume responsibility for content contributed by Users on the Platform.

24.2 Exposure Acknowledgement

Users acknowledge that they may be exposed to content created by other Users that they find objectionable or inappropriate, and the Company shall not be held liable for such exposure.

25. PAYMENT TERMS

25.1 Free-to-Use Platform
MyDreamShot is a free-to-use, skill-based entertainment platform. The Company does not charge any participation fees, entry fees, subscription fees, or other monetary consideration for accessing or participating in any contests, activities, or skill-based challenges hosted on the Platform. All features, contests, and content are available to Users without requiring any payment.

25.2 Virtual Credits and Coupons
The Platform may, from time to time, grant virtual credits, coupon rewards, or bonus points to Users as part of promotional activities, referrals, or participation incentives.

25.2.1 Such virtual credits, coupons, or bonus points have no real-money value.
25.2.2 They cannot be withdrawn, transferred, exchanged, sold, or converted into cash.
25.2.3 They may be used only within the Platform to participate in skill-based contests or other interactive activities.
25.2.4 They are not redeemable for cash, goods, or services outside the Platform.

All virtual credits and coupons are issued at the sole discretion of the Company and may be modified, expired, suspended, or revoked at any time without prior notice.

25.3 Sponsored Rewards and Prizes
Certain contests or challenges on the Platform may display prizes, vouchers, or brand-sponsored rewards. Such rewards are sponsored or provided by third-party partners and do not represent cash payouts from MyDreamShot. The Company merely facilitates the skill-based contest mechanism and distribution of sponsor-funded rewards and does not engage in monetary collection, wagering, or betting activities.

25.4 Taxes and Legal Compliance
As the Platform does not facilitate deposits, withdrawals, or monetary transactions from Users, no GST, TDS, or similar financial levies apply to User participation on MyDreamShot. Any third-party sponsor or advertiser providing tangible rewards shall be independently responsible for complying with applicable tax laws in India.

4. REFUND/CANCELLATION - CONTEST CANCELLATION CLARIFICATION (Section 25.5 Enhancement)

Current Issue: Section 25.5 correctly states refunds don't apply, but could be clearer about what happens when the Company cancels a contest due to technical issues (currently partially covered in Section 30.2).

Recommended Addition (Replace Section 25.5):

25.5 Refunds, Cancellations, and Contest Adjustments

25.5.1 No Monetary Refunds
Since the Platform is entirely free-to-use and no User is required to make any payment, deposit, or subscription to access or participate in any contest, feature, or activity, monetary refunds are not applicable under any circumstances. Users acknowledge that they have not paid any money to the Company and therefore have no claim to any monetary refund.

25.5.2 Contest Cancellation by Company
In the unlikely event that the Company cancels, suspends, or abandons a skill-based contest due to technical failures, Force Majeure Events, security concerns, or any other reason beyond the Company's control, the Company may, at its sole discretion and without any liability, take one or more of the following actions:
(a) reinstate the Dream Credits used by Users to participate in the cancelled contest, which shall be credited to the User's Dream Vault for future participation;
(b) where technically feasible, extend the contest duration or reschedule the contest to a later date, with prior notice to affected Users through the Platform or registered contact details;
(c) convert the cancelled contest into a new skill-based challenge with equivalent participation opportunities; or
(d) take any other action that the Company deems fair, reasonable, and consistent with these Terms.

25.5.3 User-Initiated Cancellation or Withdrawal
If a User voluntarily withdraws from a contest after utilizing Dream Credits to participate, or if a User fails to complete participation within the designated timeframe, the utilized Dream Credits shall not be reinstated, refunded, or credited back to the User's Account. Users are encouraged to review contest rules and timelines carefully before participating.

25.5.4 Technical Issues on User's End
The Company shall not be responsible for reinstating Dream Credits or providing any alternative compensation if a User is unable to participate in or complete a contest due to:
(a) poor internet connectivity, network latency, or mobile data issues;
(b) device malfunction, incompatibility, or insufficient technical specifications;
(c) failure to receive notifications due to spam filters, incorrect contact details, or user device settings; or
(d) any other User-side technical limitations.

25.5.5 No Cash Equivalent
Under no circumstances shall any reinstated Dream Credits, alternative participation opportunities, or compensatory measures provided under this Section be convertible into cash, money, or any monetary equivalent. All credits remain strictly non-monetary, non-transferable, and promotional in nature.

25.5.6 Finality of Decision
All decisions of the Company regarding refunds, cancellations, credit reinstatements, or contest adjustments shall be final and binding on all Users. No dispute, claim, or correspondence shall be entertained regarding such decisions.

25.6 Fraud Prevention
Users are strictly prohibited from engaging in fraudulent activities intended to manipulate the issuance or use of virtual credits or coupons, including but not limited to creating multiple accounts, exploiting system loopholes, or using automated tools. The Company reserves the right to revoke any credits, coupons, or access obtained through fraudulent or unauthorized means and to take appropriate legal or compliance action.

25.7 No Liability for External Transactions
The Company shall not be responsible for any monetary transactions conducted outside the Platform between Users or between Users and third parties. Users are advised not to engage in any payment-related activity falsely claiming association with MyDreamShot, as the Platform does not authorize any form of payment processing.


26. PREVENTION OF COLLUSION AND FRAUD – FAIR PLAY AND INTEGRITY POLICY

26.1 Commitment to Fair Play
The Company is committed to maintaining fairness, integrity, and transparency on the MyDreamShot Platform. All Users must participate honestly and responsibly in skill-based contests and activities. All contests are designed to be determined solely by skill, judgment, and precision, and not by chance or wagering.

26.2 Monitoring and Enforcement
The Company reserves the right to monitor, review, and investigate any User activity to detect unfair participation, manipulation, or coordinated behavior. If a User is found engaging in prohibited practices, including collusion, use of automated software, exploitation of system errors, or manipulation of results, the Company may suspend or permanently terminate the User’s Account.

26.3 Abuse of Credits or Rewards
Users are prohibited from abusing virtual credits, coupons, or rewards, including by creating multiple or fake accounts, attempting to transfer or trade credits, or misusing referral or sharing mechanisms. Any such misuse may result in forfeiture of all credits and permanent account termination.

26.4 Non-Monetary Structure
The Platform does not involve deposits, withdrawals, or real-money transactions. All credits are promotional in nature, non-transferable, and have no cash value. No User shall be entitled to refunds or financial compensation.

26.5 Fraud and Misrepresentation
Any User found impersonating another individual, falsifying documents, or misrepresenting eligibility information shall be permanently banned. The Company may report such conduct to law enforcement or regulatory authorities as required under Indian law.

26.6 Communication and Contact Authorization
By registering on or using the Platform, Users expressly authorize the Company to contact them via email, phone calls, SMS, or third-party messaging platforms for platform updates, contest information, promotional communications, and legal or policy notices. This authorization shall remain valid even if the User is registered under DND, DNC, or NCPR lists, unless consent is withdrawn in writing.

26.7 Right to Action
The Company reserves the right to take corrective or preventive action, including suspension, restriction, or permanent deletion of Accounts or credits, to protect the integrity of the Platform. All decisions taken under this Policy shall be final and binding.

27. INTELLECTUAL PROPERTY, USER CONTENT & TESTIMONIALS

27.1 Intellectual Property Rights

The Platform comprises a combination of content created by the Company, its affiliates, licensors, partners, and Users. All intellectual property rights in the software, source code, design, structure, user interface, visual elements, and all materials published, displayed, or made available on the Platform — including but not limited to skill-based challenges, interfaces, written content, images, logos, icons, graphics, audio-visual elements, promotional material, advertisements, and other creative assets — are the exclusive property of the Company or its authorized licensors.

Users shall not copy, modify, reproduce, distribute, transmit, display, perform, publish, license, create derivative works from, or otherwise exploit any content or material available on the Platform, in whole or in part, without prior written permission from the Company.

Nothing contained in these Terms shall be construed as granting any license, ownership right, or proprietary interest to Users in relation to any intellectual property appearing on the Platform. All rights not expressly granted are reserved by the Company.


27.2 User-Generated Content

Users are solely responsible for any text, images, videos, comments, feedback, testimonials, or other material uploaded, posted, submitted, or otherwise made available on the Platform (“User Content”).

By submitting User Content, the User represents and warrants that:

27.2.1 The User is the sole owner of the intellectual property rights in such content or has obtained all necessary permissions and authorizations;

27.2.2 The content does not infringe or violate any third-party rights, including copyright, trademark, privacy, or publicity rights; and

27.2.3 The content complies with these Terms and all applicable laws.

Users agree not to use, reproduce, or display any third-party intellectual property on the Platform without lawful authorization.


27.3 License to Use User Content

By uploading or submitting any User Content, the User grants the Company and its affiliates a worldwide, perpetual, irrevocable, royalty-free, non-exclusive, transferable, and sub-licensable license to use, reproduce, modify, adapt, publish, distribute, display, store, and otherwise exploit such content solely in connection with the operation, promotion, improvement, and lawful functioning of the Platform.

This license includes the right to:

27.3.1 Display User Content within the Platform and related materials;

27.3.2 Use User Content for promotional, informational, or transparency purposes; and

27.3.3 Retain User Content in secure systems for compliance, audit, or operational needs.

This license shall survive termination of the User’s Account to the extent required for the above purposes.


27.4 Testimonials and Media Content

If a User voluntarily provides testimonials, photographs, video recordings, audio recordings, or similar content (“Recordings”), the User acknowledges that such content is provided willingly and without expectation of compensation.

The User irrevocably grants the Company a perpetual, worldwide, royalty-free, and irrevocable right to use, reproduce, distribute, modify, publicly display, and publicly perform the Recordings, including the User’s name, image, likeness, voice, and appearance, for promotional, marketing, transparency, or informational purposes, in any media format now known or later developed.

The Company is under no obligation to use any such Recordings and may discontinue their use at its discretion.


27.5 Indemnification

Users agree to indemnify and hold harmless the Company, its directors, officers, employees, affiliates, and partners from and against any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising out of:

27.5.1 Any infringement or violation of intellectual property rights by the User;

27.5.2 Any User Content submitted by the User; or

27.5.3 Any breach of this Section or applicable laws.

The Company reserves the right to assume exclusive control of the defense of such claims.


27.6 Third-Party Intellectual Property

All trademarks, logos, names, and proprietary materials displayed on the Platform that are not owned by the Company belong to their respective owners. Any disputes relating to third-party intellectual property shall be addressed to the respective rights holders, with notice provided to the Company where applicable.

28. THIRD-PARTY SITES, SERVICES AND PRODUCTS

28.1 Partner Advertisements and Sponsored Content

The Platform may display sponsored advertisements, promotional listings, and partner content provided by brands, retailers, or service providers who have entered into lawful commercial arrangements with the Company.

All such advertisements and promotional materials are reviewed and approved by the Company prior to publication to ensure compliance with applicable Indian laws, including the Consumer Protection (E-Commerce) Rules, 2020, the ASCI Advertising Guidelines, and the Information Technology Act, 2000.

28.2 No Endorsement or Guarantee

While the Company facilitates the display of partner advertisements and promotional content, all interactions, transactions, redemptions, or communications between Users and third-party advertisers are independent, voluntary, and undertaken at the User’s discretion.

The Company does not endorse, guarantee, or make any representation regarding the quality, accuracy, legality, availability, or suitability of any goods, services, offers, vouchers, or coupons promoted by third parties.

Users are advised to review the respective partner’s terms, conditions, refund, and return policies before engaging in any transaction.

28.3 Limitation of Liability for Third-Party Dealings

Any commercial dealings, purchases, redemptions, or communications arising from partner advertisements or sponsored listings are strictly between the User and the respective advertiser.

The Company shall not be liable for:

28.3.1 The fulfillment, quality, warranty, or delivery of products or services advertised;

28.3.2 Any inaccuracies, omissions, or misrepresentations in partner-provided content; or

28.3.3 Any loss, damage, dispute, or dissatisfaction arising from reliance on third-party advertisements or offers.

28.4 Third-Party Links

The Platform may include links or references to third-party websites or services for informational, verification, or convenience purposes.

Such external sites are not under the control of the Company, and the Company bears no responsibility for their content, terms, policies, or data-handling practices. Users access such third-party resources entirely at their own risk.

28.5 Intellectual Property of Advertisers

All trademarks, logos, brand names, and promotional materials displayed in partner advertisements remain the exclusive intellectual property of their respective owners and are used under authorization, contractual permission, or lawful fair-use arrangements.


29. PRIVACY AND DATA PROTECTION

29.1 Commitment to User Privacy

MyDreamShot is committed to protecting the privacy and security of all Users who access or use the Platform.

This section explains how the Company collects, processes, stores, and protects personal information in accordance with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000.

By accessing or using the Platform, Users expressly consent to the collection and use of their information as described in this section and the Privacy Policy.

29.2 Information Collected

The Company may collect and process the following categories of information:

29.2.1 Personal Information provided by the User, including full name, email address, mobile number, date of birth (for age verification), and state or city of residence;

29.2.2 Technical and usage information collected automatically, including device type, operating system, browser type, IP address, interaction data, participation history, analytics, cookies, and crash reports;

29.2.3 Optional information, including referral details, sharing activity, advertising interactions, and contest participation records.

29.3 Purpose of Data Collection

User information is collected and used solely for lawful and legitimate purposes, including:

29.3.1 Verifying age, identity, and eligibility;

29.3.2 Enabling participation in skill-based challenges;

29.3.3 Improving platform performance, security, and personalization;

Users acknowledge that no digital system can guarantee absolute security and accept the inherent risks associated with online data transmission.

In accordance with the Digital Personal Data Protection Act, 2023, Users have the right to:

29.7.1 Access their personal data;

29.7.2 Request correction of inaccurate or incomplete data;

29.7.3 Request erasure of personal data, subject to legal obligations; and

29.7.4 Withdraw consent for data processing by contacting the Company.

Withdrawal of consent may limit access to certain Platform features that require such data.

29.8 Cookies and Tracking Technologies

The Platform may use cookies and similar technologies to enhance functionality, personalize content, and analyze usage patterns.

Users may disable cookies through browser settings, though certain features may become unavailable as a result.

29.9 Children’s Privacy

The Platform is strictly intended for Users aged eighteen (18) years and above. The Company does not knowingly collect personal data from minors. Any such data identified will be promptly deleted upon verification.

29.10 Policy Updates

The Company reserves the right to modify or update this Privacy section at any time. Updated versions shall be published on the Platform, and continued use constitutes acceptance.

29.11 Grievance Redressal

Users may contact the Company’s designated Grievance Officer for any concerns or complaints related to data protection or privacy practices, in accordance with applicable law.

30. DISCONNECTION AND TECHNICAL ISSUES

30.1 User-Side Technical Limitations

You acknowledge and agree that once a skill-based contest or activity has commenced, any inability to participate or complete an entry due to reasons beyond the Company’s control — including poor internet connectivity, mobile network latency, insufficient device performance, software incompatibility, or malfunction of personal devices — shall not entitle the User to any compensation, reinstatement, or claim.

As the Platform operates entirely on a free-credit model, the Company shall not be responsible for any loss of opportunity or participation arising from User-side technical limitations.

30.2 Company-Side Technical Interruptions

In the event of server failure, software malfunction, or critical technical disruption affecting a live contest, the Company reserves the right to:

30.2.1 Cancel or suspend the affected contest;

30.2.2 Reset or relaunch the contest once the issue is resolved; or

30.2.3 Reinstate Users with equivalent free credits or contest access, at the Company’s discretion.

No monetary refunds shall apply under any circumstances, as the Platform does not involve paid entry or real-money transactions.

30.3 No Liability for Network or Device Errors

The Company shall not be responsible for:

30.3.1 Internet disconnections, lag, or service interruptions on the User’s end;

30.3.2 Device malfunctions, overheating, or application crashes caused by third-party software;

30.3.3 Errors or delays resulting from User-side network congestion or service provider downtime; or

30.3.4 Loss of in-app progress, time, or opportunity due to device-level or third-party failures.

The User remains solely responsible for ensuring that their device and software meet the minimum technical requirements of the Platform.

30.4 Maintenance and Service Availability

The Company may periodically conduct maintenance, updates, or system enhancements that may temporarily limit or suspend Platform access. While reasonable efforts are made to ensure availability, the Company does not guarantee uninterrupted or continuous service.


31. ENFORCEABILITY AND SEVERABILITY

31.1 Binding Nature of Terms

By registering on or using the Platform, you confirm that you have read, understood, and agreed to these Terms, including contest rules, scoring systems, and participation guidelines applicable to each skill-based challenge.

31.2 Record Retention Responsibility

Users are advised to retain copies of participation details, communications, and applicable contest rules. The Company is not obligated to retain historical participation data beyond operational or legal requirements.

31.3 No Waiver

Any failure or delay by the Company in enforcing any provision of these Terms shall not constitute a waiver of its rights. The Company may enforce its rights at any time, irrespective of prior non-enforcement.

31.4 Severability

If any provision of these Terms is held to be unlawful, invalid, or unenforceable by a competent authority in India, such provision shall be deemed severed, and the remaining provisions shall continue in full force.

The invalid provision shall be replaced with a valid provision that most closely reflects the original intent of the Company.


32. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

32.1 General Disclaimer

The Platform, Website, skill-based contests, and related software are provided strictly on an “as is” and “as available” basis. The Company makes no express or implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, title, or non-infringement.

Use of the Platform is entirely at the User’s own risk. The Company does not guarantee uninterrupted, secure, error-free, or virus-free operation.

32.2 User Responsibility

Participation in all skill-based contests and activities is voluntary and undertaken for entertainment purposes only. The Platform involves no entry fees, wagering, or monetary risk.

The Company shall not be liable for any loss of opportunity, interruption, or dissatisfaction arising from technical issues, device limitations, or third-party failures.

32.3 Force Majeure
The Company shall not be liable for any failure, delay, interruption, or disruption in the operation of the Platform, or for any loss, damage, or inconvenience suffered by Users, arising directly or indirectly from any cause or event beyond the Company's reasonable control ("Force Majeure Event").

32.3.1 Definition of Force Majeure Events
Force Majeure Events shall include, but are not limited to:
(a) Acts of God, including earthquakes, floods, cyclones, storms, landslides, fires, epidemics, pandemics, or other natural disasters;
(b) War, hostilities, invasion, act of foreign enemy, military or civil unrest, terrorism, riots, insurrection, or civil commotion;
(c) Governmental actions, including changes in law, regulations, orders, directives, notifications, or judgments of any governmental authority, court, or tribunal;
(d) Strikes, lockouts, labor disputes, or industrial disturbances affecting the Company's operations or those of its service providers;
(e) Power outages, internet service disruptions, telecommunication failures, or breakdowns of essential infrastructure;
(f) Cyber-attacks, denial-of-service attacks, hacking, malware, ransomware, or other malicious acts by third parties;
(g) Failure or unavailability of third-party services, including cloud hosting providers, payment gateways (if applicable), analytics platforms, or advertising networks;
(h) Explosions, accidents, or equipment failures; and
(i) Any other event or circumstance not reasonably foreseeable or beyond the Company's control.

32.3.2 Effect of Force Majeure
Upon the occurrence of a Force Majeure Event, the Company's obligations under these Terms shall be suspended for the duration of such event, to the extent affected thereby. The Company shall use reasonable efforts to mitigate the impact of the Force Majeure Event and to resume normal operations as soon as practicable.

32.3.3 Contest and Feature Adjustments
If a Force Majeure Event affects any ongoing skill-based contest, challenge, or Platform feature, the Company reserves the right, at its sole discretion, to:
(a) extend the contest duration;
(b) suspend the contest until the Force Majeure Event subsides;
(c) cancel the contest and, where feasible, reinstate any Dream Credits used for participation; or
(d) take any other action reasonably necessary to maintain fairness and integrity.

32.3.4 No Liability
The Company shall not be liable for any direct, indirect, incidental, or consequential loss or damage arising from or related to any Force Majeure Event, including loss of opportunity, inability to participate, or disappointment. Users acknowledge that the Platform operates on a free-to-use model and that no monetary consideration is involved, and therefore no monetary claims shall arise from such events.


32.4 No Outcome or Reward Guarantee

The Company makes no guarantees regarding contest outcomes, results, or chances of winning. All rewards are sponsor-funded promotional items, and no cash alternatives are offered.

32.5 Software and Data Disclaimer

Users are solely responsible for safeguarding their devices and data. The Company disclaims liability for device damage, data loss, malware exposure, or technical repair costs arising from Platform use.

32.6 Third-Party and User Conduct Disclaimer

The Company shall not be liable for User-generated content, third-party conduct, misleading advertisements, unauthorized account use, or reliance on external offers.

32.7 Limitation Period

To the extent permitted by law, any claim arising from Platform use must be brought within one (1) year from the date the cause of action arises. Claims filed thereafter shall be barred.

33. INDEMNIFICATION AND LIMITATION OF LIABILITY

33.1 Limitation of Liability
You expressly understand and agree that under no circumstances shall the Company, its affiliates, licensors, service providers, partners, or representatives be liable to you or any third party for any form of damages, whether direct, indirect, incidental, special, exemplary, punitive, or consequential, arising out of or in connection with your access to, use of, or inability to use the Platform.

33.2 This limitation includes, without limitation, damages or losses relating to loss of data, content, or personal information; loss of goodwill or reputation; inaccurate or delayed results; device malfunction, data corruption, or unauthorized access; personal injury or emotional distress; and errors, omissions, interruptions, or failures of transmission.

33.3 Even if the Company has been advised of the possibility of such damages, and regardless of whether the claim arises under contract, tort (including negligence), statute, or any other legal theory, the Company’s aggregate liability shall not exceed the value of any free credits or non-monetary rewards associated with the User’s participation, which are themselves non-cash, non-transferable, and non-redeemable.

33.4 To the fullest extent permitted by law, the Company disclaims all liability for the actions or omissions of third-party partners, advertisers, sponsors, or other Users of the Platform.

33.5 User Indemnity Obligations
You agree to indemnify, defend, and hold harmless the Company, its affiliates, directors, officers, shareholders, employees, licensors, and agents from and against any and all claims, liabilities, losses, damages, costs, penalties, or expenses (including reasonable legal fees) arising out of or related to:

  • Your breach of these Terms or applicable policies;

  • Your misuse or unauthorized use of the Platform;

  • Your violation of any applicable laws or regulations;

  • Your submission or sharing of infringing, unlawful, or misleading content;

  • Any fraudulent, deceptive, or unlawful conduct;

  • Any use of your Account credentials by another person; or

  • Any interaction with third-party advertisers, sponsors, or service providers.

33.6 If any regulatory authority or third party imposes a fine, penalty, or demand upon the Company due to your actions or omissions, you shall be solely responsible for indemnifying the Company for such amounts.

33.7 Survival of Indemnity
Your indemnification obligations shall survive the suspension, termination, or deactivation of your Account and your access to the Platform.

33.8 You acknowledge that laws may vary by jurisdiction and that it is your sole responsibility to ensure compliance with applicable laws. The Company shall not be liable for any consequences arising from such non-compliance.


34. TERMINATION

34.1 Right to Modify or Suspend
The Company reserves the right, at its sole discretion, to modify, update, suspend, or discontinue any part of the Platform at any time, including contests, features, services, integrations, or advertisements, without prior notice.

34.2 The Company may restrict or deactivate User access where it determines that:

  • These Terms or applicable laws have been violated;

  • Fraudulent, abusive, or disruptive behavior has occurred;

  • Such action is necessary for compliance, maintenance, or security; or

  • Continued access may harm the Platform, other Users, or partners.

34.3 The Company shall not be liable for any modification, suspension, or discontinuation of the Platform, whether temporary or permanent.

34.4 Termination of Access
The Company may terminate, deactivate, or restrict your access to the Platform at any time if it reasonably believes that you have breached these Terms or engaged in conduct detrimental to the Platform or its Users.

34.5 Upon termination, you must immediately cease using the Platform. Any non-monetary credits, rewards, or virtual points associated with your Account may be forfeited and shall carry no cash value.

34.6 Termination shall not affect any rights or obligations accrued prior to termination, including liabilities arising from your conduct.

34.7 Survival of Obligations
Provisions relating to intellectual property, indemnification, limitation of liability, license grants, governing law, jurisdiction, confidentiality, and data protection shall survive termination.

34.8 The Company’s decision to terminate or restrict access shall be final and binding, and Users shall have no claim, refund right, or entitlement arising from such termination.

35. AGREEMENTS WITH THIRD PARTIES

35.1 The Company may, at its sole discretion and from time to time, enter into separate agreements with third-party service providers, contractors, or operational agents (“Agents”) to support or facilitate the operation of the Platform, including but not limited to advertising delivery, user verification, analytics, hosting, maintenance, technical support, and compliance management.

35.2 Such agreements are entered into solely for the Company’s internal and operational purposes, with the objective of maintaining, supporting, and enhancing the functionality, security, compliance, and overall user experience of the Platform.

35.3 Users expressly acknowledge and agree that:

  • they are not a party to, nor a beneficiary of, any agreement between the Company and its Agents;

  • they shall have no rights, claims, or entitlements arising from any such agreements;

  • the Company remains solely responsible for ensuring that its Agents comply with applicable data protection, confidentiality, and cybersecurity laws; and

  • any interaction a User may have with such Agents (where applicable) shall be governed exclusively by these Terms.

35.4 No privity of contract exists or shall be deemed to exist between any User and the Company’s Agents by virtue of the User’s access to or use of the Platform. All operational rights and obligations remain vested solely with the Company.

36. PUBLICITY AND PROMOTIONAL ACTIVITIES

36.1 Winner Announcements and Media Use

By participating in any skill-based contest, activity, or promotion on the Platform, Users expressly consent to the use of their name, likeness, photograph, voice, and video recordings by the Company for the purposes of announcing winners, verifying authenticity, and promoting legitimate Platform operations.

The Company may publish winner details, including name, city, and verified contest results, on the Platform, official social media channels, or through authorized media partners, in compliance with applicable laws and privacy standards.

No additional compensation shall be payable for such use, and Users waive any right to inspect or approve the final promotional materials.

36.2 Prize Delivery and Verification Footage

To ensure transparency, trust, and compliance with applicable laws, authorized Company representatives may personally visit the winner's registered address (within India) to hand over the prize.

36.2.1 Identity Verification Process
This process may include identity verification using any of the following methods, at the winner's option and convenience:
(a) Government-issued photo identification (such as Voter ID, Passport, Driver's License, or any other valid document);
(b) Aadhaar-based verification, conducted strictly in accordance with the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016.

36.2.2 Aadhaar Verification - Specific Safeguards
If the winner voluntarily chooses to use Aadhaar for identity verification:
(a) such verification shall be conducted only through a government-authorized e-KYC mechanism or a registered Aadhaar authentication agency;
(b) the Aadhaar number (UID) shall be used solely for the limited purpose of age and identity verification;
(c) the Company shall not store, retain, or archive the Aadhaar number or any core biometric information after verification is complete;
(d) any authentication requests shall be made with the winner's explicit, informed consent, obtained in writing or through a verifiable electronic record; and
(e) the winner retains the right to refuse Aadhaar-based verification and may provide alternative valid identification without affecting their eligibility to receive the prize.

36.2.3 Documentation and Media
The verification process may include prize handover video or photographic documentation for transparency, verification, and promotional purposes. All such media content shall be handled and stored securely in accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act).

36.2.4 Optional Winner Participation
Winners may also be invited to provide optional interviews or testimonials. Such participation is purely voluntary and subject to the winner's explicit consent. Refusal to participate in any publicity activity shall not affect the winner's entitlement to the declared prize.


36.3 Promotional Campaigns and Partner Collaborations

The Company may conduct promotional campaigns, referral programs, or sponsor-backed initiatives, including brand collaborations.

Minor edits may be made for clarity or formatting, without altering the original meaning.

36.5 Advertising and Brand Representation

All advertisements, banners, and creative materials displayed on the Platform are either produced by the Company or authorized by verified brand partners.

The Platform adheres strictly to Advertising Standards Council of India (ASCI) guidelines to ensure advertisements are lawful, accurate, and not misleading.

37. GRIEVANCE REDRESSAL, GOVERNING LAW, AND DISPUTE RESOLUTION

37.1 Grievance Redressal Mechanism

Users may raise complaints or grievances relating to the Platform or Services by contacting the designated Grievance Officer.

For escalations or legal matters, Users may also contact the Company’s appointed Nodal Officer.

Both officers shall act in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Personal Data Protection Act, 2023.

The Company reserves the right to replace or reassign such officers without prior notice.

37.1.1 Designation of Grievance Officer
In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Personal Data Protection Act, 2023, the Company has designated a Grievance Officer to address any complaints, concerns, or grievances raised by Users regarding the Platform, Services, or data handling practices.

37.1.4 Grievance Redressal Process
Any User wishing to raise a complaint or grievance may do so by submitting a written communication to the Grievance Officer via email or postal mail, providing:
(a) the User's full name and registered contact information;
(b) a clear description of the grievance, including relevant details such as contest name, date, and issue;
(c) supporting documents, if any; and
(d) the specific relief sought.

The Grievance Officer shall acknowledge receipt of the complaint within twenty-four (24) hours and shall endeavor to resolve the matter within fifteen (15) days from the date of receipt, in accordance with the IT Rules, 2021.

37.1.5 Alternative Contact for Escalations
If a User is unsatisfied with the response of the Grievance Officer, or if the grievance relates to the Grievance Officer directly, the User may contact the Company's designated Nodal Officer or send a communication to the Company's registered address for further review. The Company reserves the right to replace or reassign the Grievance Officer or Nodal Officer without prior notice, and the updated contact details shall be published on the Platform.


37.2 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

Subject to the arbitration clause below, courts located in Gurgaon, Haryana, India shall have exclusive jurisdiction over all disputes arising from or relating to the Platform or these Terms.

37.3 Arbitration

Any dispute arising out of or in connection with these Terms or the Platform shall first be attempted to be resolved amicably within fifteen (15) days of written notice.

If unresolved, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.

The seat and venue of arbitration shall be Gurgaon, Haryana, India.
Proceedings shall be conducted in English before a sole arbitrator mutually appointed by the parties.
The arbitral award shall be final and binding.
Each party shall bear its own legal costs unless otherwise directed by the arbitrator.

37.4 Right to Seek Equitable Relief

Notwithstanding arbitration, the Company may seek interim or injunctive relief from competent courts in Gurgaon, Haryana to protect its intellectual property, confidential information, or legal rights.

Such action shall not prevent the Company from pursuing arbitration remedies.

These Terms and Conditions have been reviewed by the Company’s legal department and, by accessing or using the Platform, Users agree to be legally bound by them in accordance with applicable Indian law.
